A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY,
TEXAS, AMENDING THE COLONY SENIOR CENTER POLICY AND
PROCEDURE MANUAL BY AMENDING ATTACHMENT "A" THERETO,
POLICIES FOR RENTAL OF THE COLONY SENIOR CENTER AND RENTAL
AGREEMENT BY REPLACING WITH NEW POLICIES FOR RENTAL OF THE
COLONY COMMUNITY CENTER AND RENTAL AGREEMENT, WHICH IS
ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A";
PROVIDING A REPEALER CLAUSE; AND PROVIDING AN EFFECTIVE
DATE
WHEREAS, the City of The Colony adopted the Policy and Procedure Manual for The Colony
Senior Center by Resolution No. 04-73,passed and approved on the 13th day of September 2004; and
WHEREAS, Attachment "A" to Resolution No. 04-73 provides for the Policies for Rental and
the Rental Agreement; and
WHEREAS, the City desires to replace the Rental Policy and Retain Agreement adopted as
Attachment"A"by Resolution No. 04-73 with a new Rental Policy and Rental Agreement; and
WHEREAS, after consideration and review, the City Council finds that the Rental Policy and
Rental Agreement adopted as Attachment"A"to the Policy and Procedure Manual for The Colony Senior
Center should be amended by replacing with a new Policies for Rental of The Colony Community Center
and Rental Agreement,which is attached hereto and incorporated herein as Exhibit"A".
THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS THAT:
Section 1. That Attachment "A" to the Policy and Procedure Manual for The Colony Senior
Center as adopted by Resolution No. 04-73, be, and the same are hereby amended with a new Policies for
Rental of The Colony Community Center and Rental Agreement, which shall now read as provided in
Exhibit"A" attached hereto and incorporated herein.
Section 2. That all provisions of any resolution of the City Council of the City of The Colony in
conflict with the provisions of this resolution be, and the same are hereby, repealed, and all other
provisions not in conflict with the provisions of this resolution shall remain in full force and effect.
Section 3. This Resolution shall become effective immediately from and after its passage, as the
law and charter in such cases provide.

' . . Policies for Rental of The Colony Community Center
1. Preference will be given to requests that occur at Jeast two weeks from the date of rental, Senior hours
and activities will be scheduled a minimum of an average of 35 hours per week, except on Holiday weeks.
2. Approval of all requests will be contingent of Community Center staffing availability. A City employee will
be scheduled to be on duty during all activities. Depending on the size and nature of the event, more than
one building supervisor may be required at an additional fee.
3. The fees for the use of The Colony Community Center shall be as follows:
Large Activity Room with Kitchen (200 people maximum)
Resident Rate Non-Resident Rate
$50/Hour for first 3 hours $65/Hour for first 3 hours
$30/Hour each additional hour $40/Hour each additional hour
Large Activity Room without Kitchen (200 people maximum)
Resident Rota Non-Resident Rate

5. The City staff member or the Peace Officer on duthave the authority to terminate any party or function
within the facility as a result of any type of illegal activity such as fighting, public intoxication, etc. involving
anyone in attendance. The City staff member or the Peace Officer also have the ability to refuse
admission of individuals that exceed the building capacity or have individuals removed from the facility to
insure capacity is not exceeded per fire code. It the party/function ends due to any of these
circumstances no refund will be provided.
6. No minors are allowed to be present if alcohol is served, available, or sold. If alcohol is served, available
or sold, all rules required by TABC must be followed and met including obtaining a temporary off site
permit if applicable:
7. Depending on the nature of the event, the City reserves the right to require liability insurance covering the
event and naming the City of The Colony as additional insured.
8. Youth oriented events will require adult chaperones at the ratio of one adult for every
15 children participating. A chaperone list must be including names, addresses
and telephone numbers.
9. Any food preparation on site will require a Health Permit be obtained from the Inspections Department at
the expense of the renting party.
10. There will be a $200 maintenance deposit required for all groups/organizations renting The Colony
Community Center if alcohol will not be served or available. The deposit is$500 if alcohol will be served
or is available. The deposit must be paid at least one week prior to the event. The money will only be
deposited by the City for the repair of any damages, misuse or neglect of the facility during that
organization's usage. If damages exceed the amount of the deposit, it is the responsibility of the renting
party to pay the additional cost of repairs.
11. Clean up of the facility is the responsibility of the renting party.
12. Reservations are not secured until full payment has been received. Failure to pay will result in rental
cancellation.
13. Damages must be reported to the Community Center employee immediately, whether they are caused by
accident, mischief,vandalism, or an act of nature.
14. The City of The Colony will not be responsible for items left in the building by groups using it,
15. No smoking is allowed on the premises.
16. Equipment may not be removed from the facility.
17, if possible, all rental requests require a minimum of a two-week notice. Those requests not meeting
these criteria will be evaluated on a case-by-case basis in an effort to limit the disruption of scheduled
senior activities.
18. Senior non-profit groups (e.g. AARP, Colony Cut-ups, Senior Citizens of The Colony) may use the facility
free of charge and without a security deposit. A minimum of 2 weeks notice is required for all rental
requests. All requests will be evaluated on a case-by-case basis and based on availability of space. All
other nonprofit groups may use the facility at 50% of the rental rate with a minimum of two weeks notice
and based on availability.

RENTAL AGREEMENT
THE COLONY COMMUNITY CENTER
By signing the agreement below, you accept responsibility on behalf of yourself and the members of your
organization to abide by the rules and conditions set forth for the use of The Colony Community Center(TCCC)
1. We shall pay all of our rental fees, Peace Officer charges if noquinmd, and maintenance deposits as
paquirmd, in a timely manner.
2. We understand that until all rental fees, Peace Officer charges if required, and deposits are paid, the
reservation is not confirmed.
3. We shall be financially responsible for any doma0ao, nnimuoe, or neglect for the facility that occur during
our rental of the building.
4. We shall properly clean the facility at the conclusion of our rental (including floors, tables and ohmirm,
restrooms, etc.)
5. We agree to limit our activities to our scheduled time periods.
6. We shall return tables and chairs to their proper locations at the conclusion of the event.
7. We will report any problems or damages that occur during our usage to the building supervisor
immediately upon discovery.
8. We agree to exercise care and concern at all times when using the facility, and will not disturb or utilize
items or equipment without prior consent.
9. We understand the City of The Colony acceptno liability for any damage to persons arising from use to
TCCC, and any persons or organizations using said facility must agree herewith.
10. We will not allow smoking in the facility at any time during our utilization.
11. We have received, read, and fully understand the policies and guidelines for rental of TCCC, and agree to
abide by those rules.
