AUSTIN RANCH BOUNDARY ADJUSTMENT AGREEMENT
AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, APPROVING A BOUNDARY ADJUSTMENT
AGREEMENT BETWEEN THE TOWN OF HEBRON, THE CITY OF
CARROLLTON, AND THE CITY OF THE COLONY, REGARDING
PROPERTY GENERALLY LOCATED ON THE NORTH SIDE OF
PLANO PARKWAY BETWEEN PARKER ROAD (FM 544) AND
WINDHAVEN PARKWAY; PROVIDING FOR LEGISLATIVE ACTS TO
GIVE EFFECT TO THE AGREEMENT; REQUIRING THAT A COPY OF
THIS ORDINANCE BE FURNISHED TO THE CITY OF CARROLLTON,
AND THE TOWN OF HEBRON; AND PROVIDING FOR AN EFFECTIVE
DATE.
WHEREAS, the City of The Colony, Texas, the Town of Hebron, and the City of
Carrollton desire to enter into a Boundary Adjustment Agreement, a copy of which is attached
hereto as Exhibit A, to make mutually agreeable changes in their boundaries.
NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY,TEXAS:
SECTION 1. The findings set forth above are incorporated into the body of this Ordinance
as if fully set forth herein.
SECTION 2. That the Boundary Adjustment Agreement, a copy of which is attached
hereto as Exhibit A, is hereby approved by the City Council of the City of The Colony, Texas, and
the City Manager is authorized and directed to take those steps reasonable and necessary to comply
with the intent of this Ordinance, and to execute the same.
SECTION 3. That the City Council for the City of The Colony, Texas, authorizes the City
Secretary to furnish an executed copy of this Ordinance to the City Secretary of the City of
Carrollton, and the Town Secretary of the Town of Hebron.
SECTION 4. That the City Council finds and determines that it is necessary that it take
further legislative actions to disannex certain areas and annex certain areas to give effect to the
provisions of this Boundary Adjustment Agreement, and that it will undertake the legislative acts
required by Chapter 43 of the Texas Local Government Code to disannex and annex as required by
said Agreement.
SECTION 5. This Ordinance shall become effective from and after its date of passage in
accordance with law.

§ AGREEMENT
DENTON COUNTY §
This Boundary Adjustment Agreement ("Agreement") is made by and between the
City of The Colony ("Colony"), the Town of Hebron ("Hebron") and the City of Carrollton
("Carrollton"), municipalities organized under the laws of the State of Texas (collectively,
the "Cities") and is to witness the following:
WHEREAS, Colony, Hebron and Carrollton are adjacent municipalities which desire
to make mutually agreeable changes in their boundaries; and
WHEREAS, state law authorizes local governments to enter into agreements of the
nature envisioned in this Agreement; and
WHEREAS, it is the desire of the Cities to adjust the boundary limit lines between
the municipalities so that the resultant boundary lines among them will be as shown by
the map attached hereto as an exhibit, after the requisite steps for annexation and
disannexation required by the Texas Local Government Code have been taken by each city to
give effect to this Agreement; and
WHEREAS, the Cities deem such Agreement to be beneficial to the public interest and
to enhance the future growth and development of each;
NOW, THEREFORE, for the mutual consideration hereinafter stated, the cities agree
and understand as follows:
I.
BOUNDARY ADJUSTMENT AND RELEASE OF EXTRATERRITORIAL
JURISDICTION
The Cities agree that this boundary adjustment between them is to establish
new boundary lines for each city as described and depicted in Exhibit "B" attached hereto
and made part hereof for all purposes, and each, by its official action approving this
Agreement, agrees to take the necessary legislative steps to accomplish the objective of the
Agreement, so that Exhibit "B" will accurately depict the resulting boundary limits between
them.
II.
CHARACTER OF AGREEMENT;
BREACH
The parties agree that this Agreement is entered into only for the mutually agreeable
adjustment of their boundaries as described herein and is not an interlocal cooperation
agreement for the joint performance of any services by the parties. Failure of any city to
perform the terms of this Agreement shall constitute a breach thereof, and the aggrieved
municipality may file suit in a court of competent jurisdiction in Denton County, Texas, to
enforce the provisions of this Agreement. However, this Agreement is subject to all
landowners requesting annexation. A city will not be held in breach of this Agreement due to a
lack of voluntary annexation.
III.
PERFORMANCE
The parties agree that the legislative acts to be performed by the cities
hereunder, including disannexation, waiver of extraterritorial jurisdiction, and
annexation, will be coordinated between them so as to be performed simultaneously or as
close thereto as possible, consistent with applicable law.
IV.
IMMUNITY AND DEFENSES
It is expressly understood and agreed that, in the execution of this Agreement, no
party waives, nor shall be deemed hereby to have waived, any immunity or defense that
would otherwise be available to it against claims arising in the exercise of governmental
powers and functions. By entering into this Agreement, the parties do not create any
obligations, express or implied, other than those set forth herein, and this Agreement shall not
create any rights in parties not signatories hereto.
V.
SEVERABILITY
If any provision of this Agreement is held to be illegal, invalid or unenforceable,
the legality, validity or enforceability of the remaining provisions of this Agreement shall not
be affected and shall remain in full force and effect.
In witness whereof, the cities, acting under the authority of their respective governing
bodies, have caused this Agreement to be executed in multiple originals to be effective as of
the date of the latest acknowledgement below.
