HomeMy WebLinkAboutResolution No. 2014-057 CITY OF THE COLONY, TEXAS RESOLUTION NO. 2014- ®5'M A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING THE TERMS AND CONDITIONS OF THE ENGINEERING SERVICES CONTRACT BY AND BETWEEN THE CITY OF THE COLONY AND LANDTEC ENGINEERS, LLC FOR CONSTRUCTION MATERIALS ENGINEERING AND TESTING SERVICES FOR RELOCATION OF THE CITY'S UTILITIES ON F.M. 423, WHICH IS ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City and Consultant have entered into an agreement such that the Consultant is to provide the following services: CONSTRUCTION MATERIALS ENGINEERING AND TESTING SERVICES FOR RELOCATION OF THE CITY'S UTILITIES ON F.M. 423; and WHEREAS, the City has determined that it is in the best interest of the City to enter into the Contract with LANDTEC ENGINEERS, LLC, which is attached hereto and incorporated herein by reference as Exhibit"A,"under the terms and conditions provided therein. WHEREAS, with this Contract the City of The Colony is agreeing to pay the sum not to exceed $167,709.00 for such work. WHEREAS, funding will be provided by Regional Toll Revenues through the North Central Texas Council of Governments and Denton County. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The Engineering Services Contract, which is attached and incorporated hereto as Exhibit "A",having been reviewed by the City Council of the City of The Colony,Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved in the amount not to exceed $167,709.00, and the City Manager is hereby authorized to execute the Contract on behalf of the City of The Colony, Texas. Section 2. That this Resolution shall take effect immediately from and after its adoption and it is so resolved. The City Inspector will perform inspection of the utility line construction and the Professional will provide testing of the backfill material to determine its conformance with the project specifications. The Professional's services will be similar to the testing being provided by the Professional for the Highway 121 /South Colony project where VRX is providing inspection. 1.0 GENERAL Utility lines will be installed along FM 423 from Station 427 on the north end near Oak Street to Station 575 on the south end and near the intersection with State Highway 121 (Sam Rayburn Tollway). The specifications to be followed for placement of backfill material include the City of the Colony specifications and COG specifications. TxDOT specifications do not apply to this phase of the project. The utility plans were provided to the Professional in PDF format so that a"take-off'could be made of the water and sanitary sewer utility lines with respect to length and depth. The following is a summary of the Professional's take-off of the plan and profile sheets. The excel spreadsheets are attached and are part of this Professional Services Agreement. PRUI1•SSIONAL SERVICES AGREEMENT LANDTEC ENGINEERS.FM 423 WATER AND SANITARY TESTING SERVICES-Page I I 2.0 BASIC SCOPE OF SERVICES The following paragraphs detail the Professional's basic scope of services for the construction materials engineering and testing,coordination of field technicians and related engineering review of testing for the project. As a general overview,the Professional's scope of work includes the following: ■ Per the City's request,provide a soil technician on-site six days per week for half days. ■ Provide experienced engineering technicians to perform testing services during backfill construction and work with the City Inspector. ■ Perform moisture/density relationships,ASTM D698 (standard Proctor),Atterberg Limits (liquid and plastic limits)for backfill. ■ Perform compaction tests using a nuclear density device (Troxler gauge). Determine the density and moisture content,percent compaction on backfill material. ■ Provide an experienced geotechnical/materials engineer(Registered Professional Engineer in Texas)to provide oversight and coordination of the engineering technician's daily work, review test data and review test report submittals. 3.0 ADDITIONAL SERVICES The following services are not included in the Basic Services and will be considered as Additional Services, if and when required or requested: • Additional hours,tests or trips for the engineering technician beyond the specific hours/trips detailed on the attached spreadsheet. • Additional engineering,site visits,report review and preparation time beyond what is outlined in basic services and detailed on the attached spreadsheets. • A construction time frame greater than the 50 weeks listed herein. ▪ Additional testing beyond that outlined in Basic Services on the attached spreadsheet. • Testing during a night shift has not been included in the Professional's scope or cost. • The services of specialty sub consultants or other special outside services other than those described in Basic Services. • Any other services not specifically included in Basic Services and on the attached spreadsheet. PROFESSIONAL SERVICES AGREEMENT LANr7TEC ENGINEERS.FM 423 WATER AND SANITARY TESTING SERVICES—Page 12 4.0 GENERAL INFORMATION A minimum notice of 24 hours is requested so that the Professional may effectively schedule their personnel.Tests will be conducted in areas designated to be ready for testing at the time the field representative is on site, Field test results will be given verbally to site representatives from the City and Contractor. Final test reports will be submitted after the results are reviewed by a geotechnical/materials engineer. The field representative will not enter a utility trench unless the trench is sloped and shored by the utility contractor per OSHA requirements. The presence of the Professional's field representative will be for the purpose of providing field testing. The Professional's work does not include supervision or direction of the actual work of the contractor,employees or agents of the contractor, Neither the presence of the Professional's field representative nor the observation and testing by the Professional's firm shall excuse the contractor in any way for defects discovered in his work. It is understood that the Professional's firm will not be responsible for the job or site safety on this project. Job and site safety will be the sole responsibility of the contractor PROFESSIONAL SERVICES AGREEMENT LANDTEC ENGINEERS.FM 423 WATER AND SANITARY TESTING SERVICES-Page 13 Exhibit B Budget and Work Schedule 1.0 Budget Requirements: The services will be completed on a time and materials basis for the not to exceed total cost of $167,709.00,Partial payments will be made on a monthly basis for completed portions of the work. Monthly invoices should include a detailed breakdown of the man hours and materials utilized by each individual working on the project to document charges billed by the Professional and also include the quantity and type of each material test performed. The estimated number of personnel hours and tests with associated unit costs are included in the attached spreadsheet.No work outside the approved scope of work should be performed by Professional without prior written approval and Change Order to the contract. Invoices are detailed as to date and type of sampling,test, observation,etc.,and will be submitted monthly. The actual cost will be dependent on the contractor's rate of work. The total testing cost is determined by such items as the quantity of equipment and manpower on site, length of trench backfill placed per day, daily production and scheduling,weather conditions and numerous other items that are beyond the Professional's control. The attached Cost Estimate sheet with this Professional Services Agreement provides an estimate of the number of hours,tests,transportation,report preparation and review time. The spreadsheet also presents the unit rates for the various activities. Cost for the items may vary;however,the total estimated amount will not be exceeded without notification of the City and City approval. Notes for the cost estimate are as follows: 1. Field test rates are charged per test in addition to technician hourly rates. 2. A minimum of four hours technician time and transportation charge will be billed for each call out,sample or specimen pickup. 3. Overtime rates are 1.5 times the regular rate for hours worked over 8 hours per day or hours before 7:00 AM and/or after 5:00 PM. Lab and field services performed on Saturday, Sunday and holidays will be charged at 1.5 times the regular rate. 4. Additional tests not included in this proposal will be quoted upon request. 2.0 Work Schedule: The Scope of Services,work schedule and budget is based on the available attached cost estimate provided by the Professional and consists of a construction duration for a total of 50 weeks which is the basis of the Professional's scope of services and cost estimate. Both parties agree that the not- to-exceed fee amount of$167,709.00 was based on this schedule. The services outlined in this contract will begin upon receipt of Notice to Proceed from the Owner. The Contract will be completed once project closeout activities have been completed by the Professional and accepted by the Owner. Additional Services will be performed at reasonable times and within reasonable schedules as requested by Owner.Authorized Additional Services will be billed as a separate item on invoices and a description of the Additional Services will be provided. Owner and Professional may subsequently agree in writing for additional services to be rendered under this agreement for additional negotiated compensation.
