HomeMy WebLinkAboutResolution No. 2014-041CITY OF THE COLONY, TEXAS RESOLUTION NO. 2014-041 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, APPROVING THE PROFESSIONAL SERVICES CONTRACT AMENDMENT BY AND BETWEEN THE CITY OF THE COLONY AND BRIDGEFARMER & ASSOCIATES, INC. FOR ENGINEERING SERVICES IN CONNECTION WITH THE MEMORIAL DRIVE SPRING CREEK CONNECTOR PROJECT, A SCOPE OF CONTINGENT SERVICES IS ATTACHED HERETO AND INCORPORATED HEREIN AS EXHIBIT "A"; AUTHORIZING THE CITY MANAGER TO EXECUTE THE CONTRACT AMENDMENT; AND PROVIDING AN EFFECTIVE DATE WHEREAS, the City and Consultant have entered into a Contract Amendment such that the Consultant is to provide the following services: ENGINEERING SERVICES IN CONNECTION WITH THE MEMORIAL DRIVE SPRING CREEK CONNECTOR PROJECT; and WHEREAS, the City has determined that it is in the best interest of the City to enter into the Contract Amendment with Bridgefarmer & Associates, Inc., a scope of contingent services is attached hereto and incorporated herein by reference as Exhibit "A," under the terms and conditions provided therein; and WHEREAS, with this Contract the City of The Colony is agreeing to pay the sum of $104,841, for additional engineering services for the Memorial Drive Spring Creek Connector Project, for a total project amount of $291,071.00, which includes the original contract and four (4) amendments. THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS THAT: Section 1. The Professional Services Contract Amendment Scope of Contingent Services, which is attached hereto and incorporated herein as Exhibit "A", having been reviewed by the City Council of the City of The Colony, Texas, and found to be acceptable and in the best interest of the City and its citizens, be, and the same is hereby, in all things approved for a total amount of $104,841.00. Section 2. The City Manager is hereby authorized to execute the Contract Amendment on behalf of the City of The Colony, Texas. Section 3. I)A Christie Wilson, City Secretary APPROVED AS TO FORM: Jeff Moore, (ity Attorney CITY OF THE COLONY DENTON COUNTY, TEXAS ENGINEERING DEPARTMENT ENGINEERING CONTRACT EXHIBIT A ADDITIONAL SERVICES FOR CONTRACT AMENDMENT #4 DATE: July 01, 2014 Contract Extension for Additional Services to the terms found in the original contract and amendments between the City of The Colony (Owner) and Bridgefarmer & Associates, Inc, (Engineer) for Memorial Djive/BNSF Grade Separation (Project). Pursuant to the terms spelled out in the original contract and amendments, additional services are needed for the project due to this project being split into four phases using four different contractors. These additional services include the following which requires additional labor hours: • Additional reviews of materials and shop drawings which included multiple reviews by the Engineer to obtain final approvals, • Additional site meetings with BNSF Railroad representatives beyond those identified in the original Scope of Services. • Preparation for and attendance of additional progress and site meetings to discuss the project. • Providing construction phase services for four separate projects including project representative services and Design Engineer on-site inspections. • Preparation for and attendance to four pre-bid meetings, bid openings and pre - construction meetings for each of the projects. • Printing additional sets of bidding documents for bidding purposes for four separate projects. • Preparation of four complete sets of record drawings for the City. • Plan revisions made to design and re -design to the grading and sidewalks located in the Town and Country Roadway area. • Designing and producing a preliminary concept plan for adding a median break with a left turn lane for a future driveway on the Whiteford Tract located in Frisco, Texas. Exhibit A: Contract Amendment #4 Memorial Drive/ BNSF Grade Separation Page 1 of 2 Summary of Additional Funds to Original Contract and Funding are Outlined Below: Original Contract: $ 37,259.00 Contract Amendment #l: $ 6,000.00 Contract Amendment #2: $ 130,944.00 Contract Amendment #3: $ 12,027.00 Contract Amendment #4: $ 104,841.00 New Contract Total: $ 291,071.00 Based on the additional funds needed and attached fee schedule, the total upper limit of this contract is now $291,071.00 including the original contract and four amendments.
