RESOLUTION NO. 2014-039
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, ACCEPTING A PETITION FILED BY CERTAIN
LANDOWNERS REQUESTING ANNEXATION INTO THE CITY OF
THE COLONY, TEXAS; SCHEDULING THE DATE, TIME, AND PLACE
FOR TWO (2) ANNEXATION PUBLIC HEARINGS ON THE PROPOSED
ANNEXATION OF APPROXIMATELY 23.466 ACRES OF LAND, AND
SCHEDULING THE DATE, TIME, AND PLACE FOR TWO (2) PUBLIC
HEARINGS ON THE DISANNEXING OF AN APPROXIMATELY 24.826
ACRE TRACT OF LAND AND AN APPROXIMATELY 2.124 ACRE
TRACT OF RIGHT-OF-WAY; AUTHORIZING AND DIRECTING THE
CITY SECRETARY AND/OR CITY STAFF TO PUBLISH NOTICES OF
SUCH PUBLIC HEARINGS; DIRECTING THE CITY OF THE
COLONY'S PUBLIC WORKS DEPARTMENT, AND/OR CITY STAFF
TO PREPARE A SERVICE PLAN FOR THE PROPOSED ANNEXATION
OF APPROXIMATELY 23.466 ACRES OF LAND ADJACENT TO THE
CITY, AS MORE PARTICULARLY DESCRIBED HEREIN.
WHEREAS, on May 28, 2014, certain owners of property adjacent to the City of The
Colony, Texas, and as described and depicted in Exhibit A, which is attached hereto, and
incorporated herein for all purposes, filed a petition, a copy of which is attached hereto as
Exhibit C, with the City of The Colony, Texas, requesting their property be annexed into the
City of The Colony, Texas; and
WHEREAS, Section 43.028(d) of the Texas Local Government Code provides that
"[a]fter the 5th day but on or before the 30th day after the date the petition is filed, the governing
body shall hear the petition and the arguments for and against the annexation and shall grant or
refuse the petition as the governing body considers appropriate"; and
WHEREAS, the City Council of the City of The Colony, Texas, finds and determines
that the approximately 23.466 acre tract of land, as described and depicted in Exhibit A, which is
attached hereto, and incorporated herein, should be annexed into the City of The Colony, Texas;
and
WHEREAS, the City Council of the City of The Colony, Texas, intends to annex
approximately 23.466 acres of land, as described and depicted in Exhibit A, which is attached
hereto, and incorporated herein, which are adjacent to the City's limits; and
WHEREAS, Section 43.063 of the Texas Local Government Code requires the
scheduling and conducting of two (2) public hearings on the annexation of said real property;
and
WHEREAS, Section 43.065(a) of the Texas Local Government Code provides that
before the publication of annexation public hearing notices the governing body of the
municipality proposing the annexation must direct its planning department or other appropriate
municipal department to prepare a service plan that provides for the extension of full municipal
services to the area to be annexed; and
WHEREAS, said property owners have also requested the City of The Colony disannex
from the corporate limits of the City of The Colony, Texas, an approximately 24.826 acre tract of
land and an approximately 2.124 acre tract of right-of-way, as depicted in Exhibit B, which is
attached hereto and incorporated herein for all purposes.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE
CITY OF THE COLONY, TEXAS, AS FOLLOWS:
Section 1. That the foregoing recitals are hereby found to be true and correct findings
of the City of The Colony, Texas, and are fully incorporated into the body of this Resolution.
Section 2. That pursuant to Section 43.028 of the Texas Local Government Code, as
amended, the City Council of the City of The Colony, Texas, accepts and grants the property
owner's petition for annexation into the City of The Colony, Texas.
Section 3. That pursuant to Section 43.063 of the Texas Local Government Code, as
amended, the City Council of the City of The Colony, Texas, schedules two (2) annexation
public hearings to be held on Tuesday, July 15, 2014, at 7:00 p.m., and on Tuesday, July 15,
2014, at approximately 7:15 p.m. in the City Hall of the City of The Colony, Texas. At the two
(2) annexation public hearings all interested persons shall have the right to appear, and be heard
on the proposed annexation by the City of The Colony, Texas, of the approximately 23.466 acres
of land, as depicted in Exhibit A, which is attached hereto and incorporated herein for all
purposes.
Section 4. That consistent with Sections 43.063 and 43.142 of the Texas Local
Government Code, as amended, the City Council of the City of The Colony, Texas, schedules
two (2) public hearings to be held on Tuesday, July 15, 2014, at 7:00 p.m., and on Tuesday,
July 15, 2014, at approximately 7:15 p.m. in the City Hall of the City of The Colony, Texas. At
the two (2) public hearings all interested persons shall have the right to appear, and be heard on
the proposed disannexation by the City of The Colony, Texas, of the approximately 24.826 acres
of land and an approximately 2.124 acre tract of right-of-way, as depicted in Exhibit B, which is
attached hereto and incorporated herein for all purposes.
Section 5. That the City Manager and/or City Staff of the City of The Colony, Texas,
is hereby authorized and directed to cause notice of such public hearings to be published once in
a newspaper having general circulation in the City of The Colony, Texas, and in the described
territory not more than twenty (20) days nor less than ten (10) days prior to the date of such
meeting, all in accordance with Section 43.063(c) of the Texas Local Government Code.
Section 6. That the City Council of the City of The Colony, Texas, directs the City's
Public Works Department, City Manager, and/or City staff to prepare a service plan that provides
for the extension of full municipal services to the approximately 23.466 acres of land, said
property being further depicted in Exhibit A, which is attached hereto and incorporated herein
for all purposes.
Section 7. That the City Council of the City of The Colony, Texas, directs the City's
Public Works Department, City Manager, and or City staff to prepare a service plan which shall
provide full municipal services by any of the methods by which it extends services to any other
area of the City of The Colony, Texas.
Section 8. That this Resolution shall become effective from and after its passage.

PETITION REQUESTING ANNEXATION BY AREA LANDOWNERS
TO THE CITY COUNCIL OF THE CITY OF THE COLONY, DENTON COUNTY, TEXAS:
The undersigned owners of the hereinafter described tract of land, which is vacant and without
residents, or on which fewer than three (3) qualified voters reside, hereby petition your honorable
Governing Body, to expand the present City limits, pursuant to Section 43.028 of the Texas Local
Government Code, so as to include as part of the City of The Colony, Denton County, Texas, the
following described territory, to wit:
An approximately 23.466 acre tract of land generally located on the north side of Piano
Parkway between Parker Road (FM 544) and Windhaven Parkway, contiguous and
adjacent to the City of The Colony, Denton County, Texas, and as more particularly
described on Exhibit A attached hereto and incorporated herein for all purposes.
We certify that the above described tract of land is contiguous and adjacent to the City of The Colony,
Texas, is not more than one-half mile in width, and that this petition is signed and duly acknowledged by
each and every person having an interest in said land.
