ORDINANCE NO. 2014-2065
PD -16, CASCADES TRACT E SIGNAGE
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS, AMENDING
PLANNED DEVELOPMENT 16 (PD -16) TRACT E, BEING MORE
PARTICULARLY DESCRIBED IN EXHIBIT "A," WHICH IS ATTACHED
HERETO AND INCORPORATED HEREIN, BY REVISING CERTAIN
DEVELOPMENT REGULATIONS, BEING MORE PARTICULARLY
DESCRIBED IN EXHIBIT "B," WHICH ARE ATTACHED HERETO AND
INCORPORATED HEREIN, PROVIDING A REPEALING CLAUSE;
PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS
CLAUSE; PROVIDING A PENALTY OF FINE NOT TO EXCEED THE
SUM OF TWO THOUSAND DOLLARS ($2,000.00) FOR EACH OFFENSE;
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, the City Council approved the Planned Development zoning for PD -16 Tract
E on or about July 26, 1999; and
WHEREAS, on or about July 25, 2005, the City Council approved a text amendment for
PD -16 Tract E; and,
WHEREAS, after discussion and consideration, the City Council has determined that the
Revised Development Standards for PD -16, which is attached hereto and incorporated herein by
reference, should be approved.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
SECTION 1. That PD -16, being more particularly described in Exhibit "A," which is
attached hereto and incorporated herein, is hereby amended by revising certain development
regulations for the development, described in Exhibit "B."
SECTION 2. That the Development Plan previously adopted is hereby amended with the
amended Development Plan, which is attached hereto and incorporated herein as Exhibit "B," be,
and the same is, hereby approved.
SECTION 3. That this Planned Development shall be developed and used only in
accordance with the Comprehensive Zoning Ordinance and Ordinance No. 2005-1604, PD -16, as
amended, and the Revised Development Standards as provided in the attached Exhibit "B" and
herein adopted shall govern the development of said property.
SECTION 4. That should any sentence, paragraph, subdivision, clause, phrase or section
of this resolution be adjudged or held to be unconstitutional, illegal or invalid, the same shall not
affect the validity of this resolution as a whole, or any part or provision thereof other than the part so
decided to be unconstitutional, illegal or invalid, and shall not affect the validity of the
Comprehensive Zoning Ordinance as a whole.

SECTION 5. That the Zoning Ordinance of the City of The Colony, Texas, as amended,
and Ordinance No. 2005-1604 shall remain in full force and effect, save and except as amended by
this ordinance.
SECTION 6. That any person, firm or corporation violating any of the provisions or terms
of this ordinance shall be subject to the same penalty as provided for in the Code of Ordinances of
the City of The Colony, Texas, as heretofore amended, and upon conviction shall be punished by a
fine not to exceed the sum of Two Thousand Hundred ($2,000.00) Dollars for each offense; and
each and every day such violation shall continue shall be deemed to constitute a separate offense.
SECTION 7. That this ordinance shall take effect immediately from and after its passage
and the publication of its caption, as the law and charter in such cases provide.

PD -16 CASCADES TRACT E SIGNAGE REGULATIONS
Amend Ordinance No. 2005-1604, Section 8, as follows:
"The following types of signs shall be prohibited within Tract E:
1. Pylon Signs, and
2. Inflatable Signs.
Feather Signs may only be displayed as part of a grand opening, and then for a maximum
duration of thirty (30) days.
Banners may only be displayed as part of a grand opening, may only be mounted on the
building in which the grand opening is taking place and then for a maximum duration of thirty
(30) days.
Both banners and feather signs must be kept in good repair and feather signs must be erected
to maintain 90 degrees from grade and uniform spacing. Any temporary sign shall be removed
by The Cascades Association if it is displayed in a torn or faded condition, without refund of city
permit fees.
All signs are subject to review by The Cascades Association prior to being submitted to the City
of The Colony, along with the appropriate application and fee, for City review and approval.
Any sign that is deemed to be inappropriate to the standards of The Cascades Association may
appeal to the City's Sign Board of Appeals for a ruling. The Sign Board of Appeals decision shall
be final."
