MINUTES
CITY OF THE COLONY
PLANNING AND ZONING COMMISSION
FEBRUARY 25, 2014
After determining that a quorum was present, the Planning and Zoning Commission of the City
of The Colony, Texas convened into Regular Session which was held on Tuesday, February 25,
2014 at 6:30 Pm in the City Council Chambers located in City Hall, 6800 Main Street, The
Colony, Texas, at which time the following item was addressed:
Board Members Present: Karen Hames, Chairman; Shannon Hebb; Cody Hall; Detrick
DeBurr; Brian Buffington and Cesar Molina Jr.
Brian Wade, Vice-Chairman arrived at 6:36 PM.
Board Members Absent: None
City Council Liaison Absent: David Terre, City Council Place 4
Staff Present: J. Michael Joyce, AICP, Planning Director; Brooks Wilson, AICP, Senior
Planner; Gordon Scruggs, Engineering Director; Brian McNuelty, Recording Secretary and Ed
Voss, City Attorney.
1.0 CALL REGULAR SESSION TO ORDER
Chairman Haines called the meeting to order at 6:30 PM.
1.2 CITIZEN INPUT
No citizens came forward during Citizen Input.
2.0 CONSENT AGENDA
2.1 Consider approval of the minutes of the February 11, 2014 Regular Meeting.
Commissioner DeBurr moved to approve the Minutes. Commissioner Hebb seconded the
motion and the motion carried (6-0).
3.0 DISCUSSION ITEM
3.1 None
4.0 PUBLIC HEARING ITEM
4.1 PDA14-0002, The Tribute Planned Developments PD-18 & PD-23
Conduct a public hearing, discuss, and consider making a recommendation to City
Council for a planned development amendment to The Tribute Planned Developments
(PD-18 & PD-23) regarding the location of temporary batch plants. The property is
located on the east and west sides of Lebanon Road on the Wynnwood Peninsula.
Ms. Wilson presented the staff report.

Commissioner DeBurr asked staff to clarify that the planned development document for PD-8
states that temporary batch plants are allowed and yet the applicant must apply for and obtain
permission for their location through the Specific Use Permit process.
Ms. Wilson answered affirmatively.
Commissioner DeBurr commented that the system seems overly complicated.
Commissioner Hall asked about the current locations for future batch plants.
Kathy Cunningham, representing Matthews Southwest, 1660 S. Stemmons Freeway, Lewisville,
Texas, stated that the two locations shown on the map are already platted residential lots and
under construction. Therefore, new locations would have to be determined. She reiterated the
request that Matthews Southwest be allowed to choose the locations of future batch plants and
stated that all the regulations and protections currently imposed on batch plant operations would
be continued.
Chairman Hames opened the Public Hearing. No one came forward to speak and Chairman
Hames closed the Public Hearing.
There being no further questions or discussion, Chairman Hames called for the motion.
Commissioner Hall moved to approve Item 4.1. Commissioner Hebb seconded the motion
and the motion carried (7-0).
4.0 PUBLIC HEARING ITEM
4.2 PDA14-0001, Stewart Peninsula Planned Development PD-8
Conduct a public hearing, discuss, and consider making a recommendation to City
Council for a planned development amendment to the Stewart Peninsula Planned
Development (PD-8) regarding the height of residences along Westway Drive. The
property is located on the north and south sides of North Colony Boulevard on Stewart
Peninsula.
Commissioners Hall and Hebb recused themselves prior to this item due to a possible conflict of
interest.
Ms. Wilson presented the staff report.
Commissioner Wade asked when the Planned Development was approved.
Mr. Mike Joyce, Planning Director, answered that PD-8 was adopted in 1996.
Chairman Hames opened the Public Hearing.
Mr. Roger Servey, 6525 Westway Drive, The Colony, Texas, representing the Stewart Peninsula
Homeowners Association, stated that he was a resident directly affected by this proposed text
amendment. He complimented the staff in discovering this discrepancy between the written PD

document and the existing buildings on the ground and urged the Commissioners to approve the
proposed change.
Commissioner Wade asked about the views from Terrace Drive and whether those homes would
be impacted.
Ms. Wilson responded that she had driven along both Westway Drive and Terrace Drive and that
the homes along Terrace Drive, because of the elevation difference, retained views of the lake.
Commissioner Molina added that he had also driven through the area and confirmed Ms.
Wilson's assessment.
Commissioner DeBurr commented that the revision was the right thing to do for the
homeowners.
There being no further comments or questions, Chairman Hames closed the Public Hearing.
Commissioner Molina moved to approve Item 4.2. Commissioner Buffington seconded the
motion and the motion carried (5-0).
There being no further questions or discussion, Chairman Hanes adjourned the Regular Session
of the Planning and Zoning Commission at 6:49 PM.
