RESOLUTION NO. 2014-004
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, DECLARING THE NECESSITY TO ACQUIRE AN
APPROXIMATELY 15,888 SQUARE FEET OR 0.365 ACRES OF LAND,
AND AN APPROXIMATELY 10,141 SQUARE FEET OR 0.232 ACRES OF
LAND, BOTH FOR RIGHT-OF-WAY PURPOSES, IN FEE SIMPLE, AND
LOCATED WITHIN THE BUFFALO BAYOU, BRAZOS & COLORADO
RAILROAD COMPANY SURVEY, ABSTRACT NO. 174, CITY OF THE
COLONY, DENTON COUNTY, TEXAS; DETERMINING THE PUBLIC USE
AND NECESSITY FOR SUCH ACQUISITION; AUTHORIZING THE
ACQUISITION OF PROPERTY RIGHTS NECESSARY FOR THE
PROJECT; APPOINTING AN APPRAISER AND NEGOTIATOR AS
NECESSARY; AUTHORIZING THE CITY MANAGER OF THE CITY OF
THE COLONY, TEXAS, TO ESTABLISH JUST COMPENSATION FOR
THE PROPERTY RIGHTS TO BE ACQUIRED; AUTHORIZING THE CITY
MANAGER TO TAKE ALL STEPS NECESSARY TO ACQUIRE THE
NEEDED PROPERTY RIGHTS IN COMPLIANCE WITH ALL
APPLICABLE LAWS AND RESOLUTIONS; AND AUTHORIZING THE
CITY ATTORNEY TO INSTITUTE CONDEMNATION PROCEEDINGS TO
ACQUIRE THE PROPERTY IF PURCHASE NEGOTIATIONS ARE NOT
SUCCESSFUL.
WHEREAS, the City Council of The Colony (hereinafter referred to as the "City Council"),
has determined that the following rights-of-way consisting of approximately 15,888 square feet or
0.365 acres of land, and an approximately 10,141 square feet or 0.232 acres of land, both of which
are situated in the Buffalo Bayou, Brazos & Colorado Railroad Company Survey, Abstract No. 174,
City of The Colony, Denton County, Texas (hereinafter referred to as the "Right-of-Way Property"),
and more particularly described and depicted in Eyhibit A, which is attached hereto and
incorporated herein for all purposes, is appropriate for use for public roadway purposes, and that
there exists a public necessity to acquire the Right-of-Way Property for the construction and
improvements to the City of The Colony's South Colony Boulevard Overpass Project, which is a
public use; and
WHEREAS, the City Council desires to acquire the Right-of-Way Property for this
governmental and public use in conjunction with the City of The Colony's South Colony Boulevard
Overpass Project; and
WHEREAS, the City Council desires that the City Manager, or his designee, take all
necessary steps to acquire the Right-of-Way Property, in fee simple, including, but not limited to, the
retention of appraisers, engineers, and other consultants and experts, and that the City Attorney, or
his designee, negotiate the purchase of the Right-of-Way Property, in fee simple, and if unsuccessful
in purchasing Right-of-Way Property, in fee simple, to institute condemnation proceedings to
acquire these required property interests.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS:
SECTION 1. That all of the above premises are hereby found to be true and correct
legislative and factual findings of the City of The Colony, Texas, and they are hereby approved and
incorporated into the body of this Resolution as if copied in their entirety.
SECTION 2. That the City Council hereby finds and determines that a public use and
necessity exists for the City of The Colony, Texas, to acquire the Right-of-Way Property for the
construction of the City of The Colony's South Colony Boulevard Overpass Project, and to acquire
the Right-of-Way Property, in fee simple, which is deemed necessary for construction and
improvements of South Colony Boulevard, which is a public roadway.
SECTION 3. That the City Manager, or his designee, is authorized and directed to negotiate
for and to acquire the Right-of-Way Property, in fee simple, for the City of The Colony, Texas, and
to acquire said rights in compliance with State and Federal law. That the City Manager is
specifically authorized and directed to do each and every act necessary to acquire the Right-of-Way
Property, in fee simple, including, but not limited to, the authority to negotiate, give notices, make
written offers to purchase, prepare contracts, to retain and designate a qualified appraiser of the
property interests to be acquired, as well as any other experts or consultants that he deems necessary
for the acquisition process and, if necessary, to institute proceedings in eminent domain.
SECTION 4. That the City Manager, or any individual he may so designate, is appointed as
negotiator for the acquisition of the Right-of-Way Property, in fee simple, and, as such, the City
Manager is authorized and directed to do each and every act and deed hereinabove specified or
authorized by reference, subject to the availability of funds appropriated by the City Council for such
purpose. That the City Manager is specifically authorized to establish the just compensation for the
acquisition of the Right-of-Way Property. That, if the City Manager or his designee determines that
an agreement as to damages or compensation cannot be reached, then the City Attorney or his
designee is hereby authorized and directed to file or cause to be filed, against the owners and
interested parties of the needed property interests, proceedings in eminent domain to acquire the
Right-of-Way Property in fee simple.
SECTION 5. This Resolution shall become effective from and after its date of passage in
accordance with law.

Description of a 15,888 square foot (0,365 acre) tract of land located in the Buffalo Bayou,
Brazos & Colorado Railroad Company Survey, Abstract No. 174, Denton County, Texas, and
being a portion of a called 32.3378 acre tract of land described in the Special Warranty Deed to
Orchard Venture, Ltd, Triangle Property 01, Ltd., and Triangle Property 04, Ltd., filed for record
in Volume 5321, Page 3471, Deed Records, Denton County, Texas, and being more particularly
described by metes and bounds as follows:
COMME NCING at a 1/2 inch iron rod found (Controlling Monument) at the northwest corner
of Lot 1, Block A, Universal Metro Holdings, Inc./121, an addition to the City of The Colony,
Denton County, Texas, according to the plat filed for record in Cabinet S, Page 146, Plat
Records, Denton County, Texas;
THENCE South 29°14'30" East, along the southwesterly line of said Universal Metro Holdings,
Inc./121, a distance of 249.38 feet, to a 518 inch iron rod set with a TxDOT 3-1/4 inch aluminum
disk at the intersection of said southwesterly line and the new northerly right-of-way line of State
Highway No, 121 (a variable width public right-of-way), said aluminum disk also being at
Station 559+02.16, 177.71 feet Left, and having a Texas Coordinate System, N.A.D. 83(2002),
North Central Zone (4202) surface coordinate of North: 7,080,187.88, East: 2,470,258.72, and
being at the POINT OF BEGINNING of the herein described tract of land;**
1) 'T'HENCE South 29114'30"East, continuing along the southwesterly line of said Universal
Metro Holdings, Inc./121, a distance of 6.55 feet, to a 518 inch iron rod set with a TxDOT 2 inch
aluminum cap on the existing northerly right-of-way line of said State Highway No. 121;
2) THENCE South 60°47'33" West, along said existing northerly right-of-way line, a distance

5) North 57°48'11" East, a distance of 104.19 feet, to a 5/8 inch iron rod with a

The bearings recited hereinabove are based on the Texas Coordinate System (N.A.D. 83), North
Central Zone (4202), and were determined by GPS observations of Monuments 12, 13, 14 and 15
of the City of The Colony Geodetic Control.

dividing by a combined scale factor of 1.000152693

BEING a lot, tract or parcel of land located in the Buffalo Bayou, Brazos & Colorado Railroad
Company Survey, Abstract No. 174, City of The Colony, Denton County, Texas, and being a
portion of a called 32.3378 acre tract of land described in the Special Warranty Deed to Orchard

BEGINNING at a 1/2 inch iron rod found on the easterly right-of-way line of South Colony

THENCE N29°15'51"W, along said easterly right-of-way line, a distance of 691.68 feet to an
iron rod set with a cap stamped "GAI" (hereinafter referred to as an iron rod set), fiom which a
1/2 inch iron rod found with a cap stamped "Pacheco-Koch" which bears N29°15'51"W, a
distance of 258.19 (Controlling Monument);
THENCE N60°44'25"E, departing said easterly right-of way line, a distance of 4.88 feet-to an
iron rod- set;
THENCE S28°58'40"E, a distance of 64.28 feet to an iron rod set;
