MINUTES
CITY OF THE COLONY
PLANNING AND ZONING COMMISSION
NOVEMBER 12, 2013
After determining that a quorum was present, the Planning and Zoning Commission of the City
of The Colony, Texas convened into Regular Session which was held on Tuesday, November 12,
2013 at 6:30 PM in the City Council Chambers located in City Hall, 6800 Main Street, The
Colony, Texas, at which time the following items were addressed:
Board Members Present: Karen Haines, Chairman; Brian Wade, Vice-Chairman; Shannon
Hebb; Cody Hall; Cesar Molina Jr.; Brian Buffington and Detrick DeBurr.
Board Member Absent: none
City Council Liaison Absent: David Terre, City Council Place 4
Staff Present: J. Michael Joyce, AICP, Planning Director; Brooks Wilson, AICP, Senior
Planner; Gordon Scruggs, Engineering Director; Felicia Campa, Acting Recording Secretary and
Ed Voss, City Attorney.
1.0 CALL REGULAR SESSION TO ORDER
Chairman Haines called the meeting to order at 6:31 PM.
1.2 CITIZEN INPUT
No citizens came forward during Citizen Input.
2.0 CONSENT AGENDA
2.1 Consider approval of the minutes of the October 22, 2013 Regular Session.
2.2 RP13-0003, The Home Depot Center Addition
Consider approval of a Replat of Lots 3, Block 1 of the Home Depot Center Addition, being a
13.38 acre tract of land, located on the north side of the Sam Rayburn Tollway (S.H. 121) and
Paige Road, into two lots, Lots 3R and 4, Block I for the purpose of selling off Lot 4.
2.3 PP13-0010 - Colony S Partners Addition, Lots 1 and 2, Block A
Consider approval of a Preliminary Plat of Lots 1-2, Block A of The Colony 5 Partners
Addition, being a 45.11 acre tract of land, located on the north side of the Sam Rayburn
Tollway (S.H. 121), south of Memorial Drive and west of South Colony Boulevard.
2.4 PP13-0011- 30/The Colony Addition, Lots 1 and 2, Block A
Consider approval of a Preliminary Plat of Lots 1-2, Block A of The Colony Crossing
Addition, Phase 2, being a 30.18 acre tract of land, located on the north side of the Sam
Rayburn Tollway (S.H. 121), south of Memorial Drive and approximately 1,230 feet
east of Paige Road.
Commissioner Hebb asked for clarification about the bearing distances for the Home Depot
replat and the 30/The Colony plat.
Daniel Stewart of Cates-Clark Engineering, 14800 Quorum Drive, Addison, Texas explained the
discrepancy resulted from the beginning point for each plat. This discrepancy will be resolved
with the sale of Lot 4 of the Home Depot Addition in the deed and corrected on the Final Plat.

Commissioner Hebb then moved to approve the Items 2.1, 2.2, 2.3 and 2.4. Commissioner
Hall seconded the motion and the motion carried (7-0).
3.0 PUBLIC HEARING ITEM
3.1 PDA13-0005, Text Amendments Eastvale Planned Development PD-1 & PD-2
Conduct a public hearing, discuss, and consider making a recommendation to City Council
regarding text amendments to revise the development standards in the Eastvale Planned
Development (PD-1 & PD-2). The property is located on the west sides of FM 423 (Main
Street) at Lake Highlands Drive.
Brooks Wilson, Senior Planner, presented the staff report.
Commissioner Molina asked why fifteen (15) feet was chosen for the required side yard at corner
setback.
Ms. Wilson explained that that setback size is typical in that it allows the adjacent front-facing
homes a reasonable site line. Lots that are platted on corners are typically wider than interior lots
to accommodate the increased side yard setback.
Commissioner Wade asked why the typical five (5) foot side yard was being reduced to four (4)
feet.
Ms. Wilson responded that the original plat showed the side yard setback as four (4) feet and that
in combining the development standards from the plat, the Zoning Ordinance and the Planned
Development document; we were obliged by the legal staff to choose the least onerous standard
when a conflict occurred. She went on to state that whichever standard was more advantageous
to the property owner would be applied in this revision.
Mike Joyce, Planning Director, went on to state that this area of town is experiencing rapid
redevelopment and these standards will support this continuing trend.
Chairman Haines opened the Public Hearing. No one came forward to speak and the Public
Hearing was closed.
Commissioner Hall moved to approve Item 3.1. Commissioner Molina seconded and the
motion carried (7-0).
4.0 WORKSHOP ITEM
4.1 SI13-0011- Schedule of Uses
An introduction to the reorganized Section 10, "Schedule of Uses," "Definitions Related to the
Schedule of Uses" and a proposed new section of the Zoning Ordinance, entitled "Regulations
for Certain Types of Permanent Land Uses."
Brooks Wilson, Senior Planner, presented the staff report.
Chairman Harries thanked the staff for their work. No other Commissioners had any comment.

There being no further questions or discussion, Chairperson Hames adjourned the meeting at
7:04 PM.
