MINUTES
CITY OF THE COLONY
PLANNING AND ZONING COMMISSION
OCTOBER 22, 2013
After determining that a quorum was present, the Planning and Zoning Commission of the City
of The Colony, Texas convened into Regular Session which was held on Tuesday, October 22,
2013 at 6:30 PM in the City Council Chambers located in City Hall, 6800 Main Street, The
Colony, Texas, at which time the following items were addressed:
Board Members Present: Karen Hames, Acting Chairman; Shannon Hebb; Cody Hall; Brian
Buffington and Detrick DeBurr.
Board Member Absent: Cesar Molina Jr.; Brian Wade arrived at 6:45.
City Council Liaison Absent: David Terre, City Council Place 4
Staff Present: J. Michael Joyce, AICP, Planning Director; Brooks Wilson, AICP, Senior
Planner; Gordon Scruggs, Engineering Director; Felicia Campa, Acting Recording Secretary and
Ed Voss, City Attorney.
1.0 CALL REGULAR SESSION TO ORDER
Chairman Hames called the meeting to order at 6:33 PM.
1.2 CITIZEN INPUT
No citizens came forward during Citizen Input.
2.0 CONSENT AGENDA
2.1 Consider approval of the minutes of the October 8, 2013 Regular Session.
2.2 FP.13-0011 CiVS Colony Addition
Consider approval of a Final Plat of Lot 3, Block A of the CVS Colony Addition, being a 1.32
acre tract of land, located on the south side of the South Colony Boulevard, approximately 450
feet east of Paige Road.
2.3 FP13-0012 - Tullamore Meadows Final Plat
Consider approval of a Final Plat of Lots 1-34, Block C for a total of thirty-four (34) residential
lots plus Lots 35X, 36X, 37X and 38X, Block C for a total of four (4) common areas of
Tullamore Meadows at The Tribute, being a 12.27 acre tract of land, located at the southwest
corner of Lebanon Road and Waverly Drive.
2.4 FP13-0013 - Aberdeen Phase 3 Final Plat
Consider approval of a Final Plat of Lots 32-91, Block A; Lots 1-15, Block B and Lots 15-27,
Block E for a total of eighty-seven (87) residential lots plus Lot 92X, Block A; Lots 16X and
17X, Block B; Lot 29X, Block C for a total of four (4) common areas of Aberdeen, Phase 3 at
The Tribute, being a 25.54 acre tract of land, located on west side of Lebanon Road at
Aberdeen Drive.
Commissioner Hebb moved to approve the Items 2.1, 2.2, 2.3 and 2.4. Commissioner Hall
seconded the motion and the motion carried (5-0).

3.0 PUBLIC HEARING ITEM
3.1 SI13-00010 - Text Amendment for Handicapped Parking
Conduct a public hearing, discuss and consider making a recommendation to City Council
regarding a text amendment to the Zoning Ordinance by adding a new Section 13-200, entitled
"Accessible Parking for Physically Handicapped Persons" and establishing regulations relating
to handicapped accessible parking.
Brooks Wilson, Senior Planner, presented the staff report.
Commissioner Hall asked if the city was changing or adding to any of the state's regulations.
Ms. Wilson answered no; that staff followed the state statutes exactly.
Mike Joyce, Planning Director, added that the section to be added to Chapter 19 concerning
enforcement is not in compliance with the state statutes. This revision will bring Chapter 19 into
compliance.
Commissioner Hebb added that he has some experience with Americans with Disabilities and
that the old requirements for a handicapped space were replaced by the requirement of a van-
accessible space. He went on to ask if staff had looked at the most recent ADA requirements.
Ms. Wilson answered no, that staff crafted the ordinance to match the state statutes and would
amend the ordinance when the state did.
Chairman Harries opened the Public Hearing. No one came forward to speak and the Public
Hearing was closed.
Commissioner Hall moved to approve Item 3.1. Commissioner Hebb seconded and the
motion carried (5-0).

3.0 PUBLIC HEARING ITEM
3.2 SP13-0017, 121 Office Complex
Conduct a public hearing, discuss and consider making a recommendation to City Council on a
request for approval of a Site Plan for two office buildings totally 25,404 square feet located on
approximately 1.95 acres of land, on the north side of the Sam Rayburn Tollway (S.H. 121)
approximately 350 feet west of Blair Oaks Drive.
Brooks Wilson, Senior Planner, presented the staff report.
Commissioner Buffington asked what furniture/amenities would be placed between the two
office buildings.
Mr. Jack Cox, 4508 Horseshoe, The Colony, Texas, representing the owner, stated that benches,
chairs and covered tables would be placed, along with grass and other landscaping.
Commissioner Buffington asked if there would be outside lighting.

Mr. Cox answered affirmatively, stating that lights would be placed on the exterior of the
buildings.
Commissioner Hebb asked if the table covers would be permanent and require a permit.
Mr. Joyce answered that any permanent structure would be permitted through the Building
Inspections Department.
Chairperson Hames opened the Public Hearing.
Carolyn Cummins, 4897 S.H. 121, The Colony, asked about the location of the dumpster
enclosure and the required and provided parking spaces.
Ms. Wilson answered by showing the location of the dumpster and stating that 85 parking spaces
were required and the applicant was providing 90 spaces.
There being no other speakers, Chairperson Haines closed the Public Hearing.
Commissioner Hall moved to approve Item 3.2. Commissioner Wade seconded the motion
and the motion carried (6-0).
There being no further questions or discussion, Chairperson Haines adjourned the meeting at
6:53 PM.
