HomeMy WebLinkAboutOrdinance No. 2013-2021 CITY OF THE COLONY, TEXAS ORDINANCE NO. 2013-2021 AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, AMENDING THE CODE OF ORDINANCES, CHAPTER 2, ARTICLE I, SECTION 2-1, BY REPEALING IN ITS ENTIRETY AND REPLACING IT WITH A NEW CHAPTER 2, ARTICLE I, SECTION 2-1, ENTITLED "ELECTIONS - DISTRICTS CREATED," BY ESTABLISHING CITY COUNCIL DISTRICT BOUNDARIES IN PLACES 3, 4, 5, AND 6 BY ORDINANCE; PROVIDING A SEVERABILITY CLAUSE; PROVIDING A SAVINGS CLAUSE; AND PROVIDING FOR AN EFFECTIVE DATE. WHEREAS, the City Council has reviewed the current City Council single-member district boundaries for city elections and based upon the United States 2010 Census figures, determined that the difference between the largest and smallest districts is thirty-six percent (36%); and WHEREAS, as a result of the disparity in population difference between the districts the City Council instructed staff to prepare redistricting options using the 2010 Census Data and according to the Redistricting Criteria Resolution No. 2013-006, adopted on January 15, 2013; and WHEREAS, City Council considered three map options at their February 19, 2013 meeting. Upon deliberation, the City Council selected all three options for further review and public input; and WHEREAS, the map options were placed on the City's website and public forums were held on March 7, 2013 and April 1, 2013. As a result of the public input, a fourth map option was considered by the City Council on May 7, 2013 and a public hearing was conducted; and WHEREAS, the City Council has discussed and considered such revisions and has determined that it is in the best interest of the City to repeal the current Chapter 2, Article I, Section 2-1, and replace it with a new Chapter 2, Article I, Section 2-1, addressing the adoption of City Council district boundaries by ordinance. NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS: SECTION 1. The findings set forth above are incorporated into the body of this Ordinance as if fully set forth herein. SECTION 2. That the Code of Ordinances of the City of The Colony, Texas be, and the same is, hereby amended by repealing Chapter 2, Article I, Section 2-1 in its entirety, and replacing it with a new Chapter 2, Article 1, Section 2-1, entitled "Elections - Districts created," which shall read as follows: "Sec. 2-1. Elections-Districts created. There are hereby created election districts for the election of four members of the council, places 3, 4, 5 and 6. The members of the council to be elected to such places shall be residents of and elected by the qualified voters of these geographical districts. Such single member geographical districts are created and described in accordance with section 2.03(a) of the Charter and shall correspond to places 3, 4, 5 and 6 respectively. Said single member geographical district boundaries shall be as established from time to time by ordinance. The ordinance creating these four districts shall remain on file in the office of the city secretary." SECTION 3. If any section, article paragraph, sentence, clause, phrase or word in this ordinance, or application thereto any persons or circumstances is held invalid or unconstitutional by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining portions of this ordinance; and the City Council hereby declares it would have passed such remaining portions of this Ordinance despite such invalidity, which remaining portions shall remain in full force and effect. SECTION 4. That all provisions of the Ordinances of the City of The Colony, Texas, in conflict with the provisions of this ordinance be, and the same are hereby amended, repealed, and all other provisions of the Ordinances of the City not in conflict with the provisions of this ordinance shall remain in full force and effect. SECTION 5. This Ordinance shall become effective from and after its date of passage in accordance with law.
