CITY OF THE COLONY, TEXAS
RESOLUTION NO. 2013-028
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, AUTHORIZING AND ALLOWING CITY
COUNCILMEMBERS TO SERVE AS VOLUNTEERS FOR
ORGANIZATIONS THAT PROTECT THE PUBLIC HEALTH, SAFETY,
OR WELFARE OF THE CITY AUTHORIZED PURSUANT TO SECTION
21.003 OF THE TEXAS LOCAL GOVERNMENT CODE; PROVIDING A
SEVERABILITY CLAUSE; PROVIDING A REPEALING CLAUSE; AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, Section 21.003 of the Texas Local Government Code provides that "[a]
member of the governing body of a municipality may serve as a volunteer for an organization
that protects the health, safety, or welfare of the municipality regardless of whether the
organization is funded or supported in whole or part by the municipality if the governing body
adopts a resolution allowing members of the governing body to perform service of that nature";
and
WHEREAS, the City Council of the City of The Colony, Texas, has determined that it is
in the best interests of the City, and its residents that City Councilmembers, if they so desire, be
permitted to volunteer for an organization that protects the health, safety, or welfare of the
municipality in accordance with Section 21.003 of the Texas Local Government Code.
NOW THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY
OF THE COLONY, TEXAS, THAT:
SECTION 1. The City Council hereby finds that it is in the best interests of the City of
The Colony, Texas, that City Councilmembers be permitted to volunteer and to serve for an
organization that protects the health, safety, or welfare of the municipality regardless of whether
the organization is funded or supported in whole or part by the municipality, pursuant to Section
21.003 of the Texas Local Government Code.
SECTION 2. If any section, article paragraph, sentence, clause, phrase or word in this
Resolution, or application thereto any persons or circumstances is held invalid or unconstitutional
by a Court of competent jurisdiction, such holding shall not affect the validity of the remaining
portions of this Resolution; and the City Council hereby declares it would have passed such
remaining portions of this Resolution despite such invalidity, which remaining portions shall remain
in full force and effect.
SECTION 3. That all provisions of the resolutions of the City of The Colony, Texas, in
conflict with the provisions of this Resolution be, and the same are hereby amended, repealed, and
all other provisions of the resolutions of the City not in conflict with the provisions of this
Resolution shall remain in full force and effect.
SECTION 4. This Resolution shall become effective from and after its date of passage
in accordance with law.
PASSED AND APPROVED BY THE CITY COUNCIL OF THE CITY OF THE
COLONY, TEXAS, THIS day of 2013.
