HomeMy WebLinkAboutResolution No. 2013-025 CITY OF THE COLONY, TEXAS RESOLUTION NO. 2013- Q"% F A RESOLUTION OF THE CITY OF THE COLONY, TEXAS, A1,N'IENDING THE TERMS AND CONDITIONS OF A CONSTRUCTION SERVICES CONTRACT BY AND BETWEEN THE CITY OF THE COLONY AND 1MARIO SINACOLA & SONS EXCAVATING, INC., FOR CONSTRUCTION OF PHASE I WIDENING OF PLANO PARKWAY; AUTHORIZING THE CITY MANAGER TO EXECUTE SAID CONTRACT AMENDMENT; PROVIDING AN EFFECTIVE DATE WHEREAS, on June 5, 2012 the City Council passed Resolution No. 2012-051 approving a contract with Mario Sinacola & Sons Excavating, Inc. for construction of Phase I widening ol'Plano Parl:Nvay: and WHEREAS, funding for the project is provided through a Local Funding Agreement with the Texas Department of Transportation through North Central Texas Council of Governments, City of Carrollton Reimbursement Agreement, Denton County Interlocal Agreement, and Billingsley Company escrowed funds. WHEREAS, the City of Carrollton has requested, at their expense, additional concrete pavement replacement, requiring the original construction contract to be amended to reflect the new total amount of $4,034,286.51 for said work. NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF THE COLONY, TEXAS, THAT: Section 1. The City Council of the City of The Colony, Texas hereby approves an amendment to the construction contract with Mario Sinacola & Sons Excavating, Inc. for construction of Phase I widening of Plano Parkway for a total amount of 54,034,286.51 for said work. Section 2. The City Manager is authorized to execute the amendment to the ConstrllctiOn Services Contract for said work. Section 3. WHEREAS, the City and Contractor have entered into an agreement such that the Contractor is to provide the following services: Plano Parkway Roadway Widening from S.H. 121 to Parker Road (F.M. 544). WHEREAS, the above referenced agreement provides that if there is a change in scope or focus of the activities in the contract, or if it is necessary for the Contractor to do additional work such that there is a significant additional cost or expense to the City, it is necessary for the City to approve such work and/or for the parties to change the contract; WHEREAS, the parties recognize that it is necessary for Contractor to do additional work under the contract, such work which is set out in the attached Exhibit "A", which is attached hereto and incorporated herein as if set out in full herein; and WHEREAS, with this Contract Amendment the City of The Colony is hereby approving such additional work and agreeing to increase the contract amount by the sum of $59,586.24. NOW, THEREFORE, for and in consideration of the mutual acts and covenants set out herein, the parties agree as follows: 1. Contractor, in addition to the work to be performed in the Contract dated June 5, 2012 shall perform the task(s) described in the attached Exhibit "A", basically described as additional services, including, but not limited to adding traffic control buttons, fiber optic conduit revisions, inlet throat removal/replacement, additional roadway paving quantity modifications, traffic signal box ground box relocations and median configuration changes. 2. The amount to be paid to Mario, Sinacola & Sons Excavating, Inc. under such contract shall be increased by the sum of $59,586.24 to reflect the work described in Exhibit "A". 3. This shall constitute an Authorization for a Change in Work as set out in the agreement between the parties, and an amendment to such contract. All of the terns and conditions of the original contract shall remain in full force and effect, as amended hereto, unless set out otherwise herein. Contract Amendrnent #3. (Contractor) for additional work requested by the City_ Pursuant to the provisions of Section 2j~age 2-5 Atli,cle 8.13 of the Contract Documents, this Supplemental Agreement, when fully executed, shall constitute the autho►•ity to change the work of the project as follows, including quantities and total dollars: Contract Amendment Explanation: City of The Colony • Additional tcnnpornry traffic buttons were requested by the City of The Colony located at the intersection of Plano Parkway and Windhaven Parkway. • City requested that the conduit running on the bridge be eliminated from the project. • City requested that the existing damaged inlet throats be removed and replaced along the roadway. • At the Windhaven Intersection, existing traffic signal ground boxes are needing to be relocated from the medians and new ground boxes installed. C Nine inch concrete was not used in City of The Colony City limits. City of Carrollton • City of Carrollton requested that the median at that intersection of Parker Road and Plano Parkway be modified since Parker Road bas not been constructed by TxDOT as was assumed it would be when the project began. This modification requires removal of the existing median and adding in a narrower median south of the "Limits of Removal" in the original contract. City of Carrollton requested that the existing damaged inlet throats be removed and replaced along the roadway. » City of Carrollton requested additional concrete panels be removed and replaced along the roadway.
