ORDINANCE NO. 2012-1983
PINE COURT ROW ABANDONMENT
AN ORDINANCE OF THE CITY OF THE COLONY, TEXAS,
VACATING, ABANDONING AND CLOSING PINE COURT, A
DEDICATED PUBLIC STREET, AS DESCRIBED IN EXHIBIT "A" AND
DEPICTED ON EXHIBIT "B," WHICH ARE ATTACHED HERETO AND
INCORPORATED HEREIN; PROVIDING FOR THE FURNISHING OF A
CERTIFIED COPY OF THIS ORDINANCE FOR RECORDING IN THE
REAL PROPERTY RECORDS OF DENTON COUNTY, TEXAS, AS A
DEED; AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the City Council of the City of The Colony, Texas, has determined that the
public street described in Exhibit "A" and depicted in Exhibit "B" no longer serves a public
purpose and is of no use to the City of The Colony; and
WHEREAS, the City Council has determined that the described property should be
abandoned, released and quitclaimed to Joe's Country Store, Inc. and its successors and assigns
in the interest of the public health, safety and general welfare;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF
THE COLONY, TEXAS;
SECTION 1. That the City Council finds that the dedicated public street known as Pine
Court, as described in Exhibit "A" and depicted in Exhibit "B," which are attached hereto and
incorporated herein by reference, no longer serves a public purpose and the same be hereby
abandoned by the City of The Colony.
SECTION 2. The City Secretary is hereby directed to certify a copy of the Ordinance
and cause it to be recorded in the Deed Records of Denton County, Texas.
SECTION 3. That the abandonment provided for herein shall extend only to the public
right, title and interest which the City of The Colony, Texas, may have in and to the surface of
said strip of publicly owned land, and shall be construed to extend only to such interests that the
governing body of the City of The Colony, Texas, may legally and lawfully abandon.
SECTION 4. That the Mayor is hereby authorized to execute and deliver a quitclaim
deed on a form approved by the City Attorney.

LEGAL DESCRIPTION
RIGHT-OF-WAY ABANDONMENT
PINE COURT (60' RIGHT-OF-WAY)
IN THE CITY OF THE COLONY, TEXAS
BEING a 0.3358 acre (14,626 square foot) Street Right-of-Way, known as Pine Court (60' Right-of-Way),
situated in City The Colony, Denton County, Texas, being dedicated by the plat of Garza - Little Elm Lake
Estates Addition, an addition to the City of The Colony, according to the Plat filed of record in Volume 2,
Page 80 of the Plat Records of Denton County, Texas, and being more particularly described by metes
and bounds as follows:
Beginning at % inch iron rod at the intersection of the North line of Overlake Drive (60' Right-of-Way)
with the West line of said Pine Court, said point also being the Southeast corner of Lot 1, Block 4 of said
Garza - Little Elm Lake Estates Addition;
THENCE, North 00 deg. 20 min. 00 sec. West, along the said West line of Pine Court a distance of 54.69
feet to a point for corner, said point being the beginning of a cul-de-sac curve to the right with a radius
of 60.00 feet, delta angle of 300 deg. 00 min. 00 sec., a chord bearing of North 89 deg. 40 min. 00 sec.
East and a chord length of 60.00 feet;
THENCE, along the said curve to the right a distance of 314.16 feet to a point for corner;
THENCE, South 00 deg. 20 min. 00 sec. East, and along East line of said Pine Court a distance of 70.34
feet, to a point in the said North line of Overlake Drive, said point also being the beginning of a curve to
the left with a radius of 185.00 feet, delta angle of 19 deg. 17 min. 42 sec., a chord bearing of North 75
deg. 42 min. 56 sec. West and a chord length of 62.01 feet;
THENCE, along the said curve to the left and said North line of Overlake Drive, a distance of 62.30 feet,
to the POINT OF BEGINNING and containing 0.3358 acres (14,626 square feet) of land, more or less.
